Unfair Dismissal – Success!


I am delighted to announce I have achieved a settlement of £10,000.00 for my client who was bringing a claim for Unfair Dismissal to the Employment Tribunal.

I met with Mr P for a fixed fee interview at one of our offices. In this interview he instructed he had been dismissed by reason of redundancy. However, the company had failed to inform him on how the decision had been made and what criteria had been used to come to the decision. There had also been no consultation process. I had serious concerns in respect of my client’s dismissal. I therefore considered he had an excellent claim for unfair dismissal.

Mr P had already appealed against the decision to dismiss him and therefore the next step was to submit a claim to the Employment Tribunal. It also transpired Mr P had the benefit of legal expenses insurance and so I liaised directly with this provider and obtained cover for him. This meant the legal bill was paid entirely by his insurance company and Mr P received all of his compensation.

The Employment Tribunal was several weeks away; however, settlement discussions had been taking place between myself and the Respondent Representative. With my client’s instructions I was able to achieve a superb outcome of £10,000.00.

Why insurers make low first offers in personal injury claims


I have just successfully settled a client’s claim for £4500.00.

Medical evidence was obtained and sent to the defendant insurers with a schedule of out of pocket exenses, requesting their settlement proposals.

The insurers put forward an offer of £1750.00. I knew immediately from my years of experience that this was a significant under-value of the claim. I assessed the value of the case, utilising case law from cases previously decided by the Courts and considered that the case was actually worth in the region of £5000.00. Several offers then passed between the parties, before eventually securing a settlement at £4500.00. In effect, the defendant insurer’s first offer represented just over only 40% of the true value of the claim.

Defendant insurers deliberately under-value cases, as a percentage of claimants are unrepresented and are “captured” directly by the defendant insurance companies, never receiving any independent advice. Defendant insurers also deliberately make low first offers, hoping that claimants will take the first offer made so as to settle the case quickly. However, once a settlement is accepted, a case cannot be re-opened.

Increased Statutory Maternity Pay


There has been a huge range of employment law reforms come into force this April. One of them (as I have previously blogged) is the increase to the unfair dismissal qualifying period of two years which took effect on 6 April. However, other changes in April include new rates of statutory maternity pay and sick pay. The Allowance has now increased from £128.73 to £135.45 as of 1 April.

Employment Tribunal Success!


We have just acted for a client who was successful in his Unfair Dismissal and Wrongful Dismissal claim and achieved in the region of £15,000 in the Employment Tribunal.

I met with Mr Y for a fixed fee interview at our Newark office. He informed me that he had been dismissed for Gross Misconduct from his employment for alleged theft. He had a significant length of service with the company and he explained that his dismissal was devastating for him. There was no firm evidence of the alleged theft and the employer’s investigation was not sufficient given the nature of the allegation. I advised Mr Y that he had excellent claims Unfair Dismissal and Wrongful Dismissal.

Mr Y had already appealed against his dismissal and so the next step was to lodge Employment Tribunal proceedings. Mr Y did not have the benefit of legal expenses insurance and so Ringrose Law were able to represent him on a “no win no fee” agreement.

The claim proceeded all the way to an Employment Tribunal hearing at which Sophie Goodwill, Employment Solicitor represented Mr Y. Mr Y was delighted to win both his claims for both Unfair Dismissal and Wrongful Dismissal. He can now move on knowing that he has been fully compensated for his losses and has a Judgment in his favour confirming that he had been unfairly and wrongly dismissed.

Unfair Dismissal – Qualifying Period


From 6th April 2012 the Government will have changed the qualifying period for protection from unfair dismissal from one year to two years. Currently, employees only need one year’s service to bring an unfair dismissal claim; however, from 6th April 2012 it will now be two years. This shall make it the same qualifying period for a claim of redundancy pay.

The change will have immediate impact on those employees who are recruited on or after 6th April 2012. Those who are already in employment before that date will retain the current one year qualifying period. The same qualifying period will apply to the right to ask for written reasons for an employee’s dismissal.

Bullied at Work?


Over the past year, I have seen an increase in the number of clients that come to see me in relation to workplace bullying that they have suffered. As such I have acted for many clients who have felt bullied and harassed in the workplace and is one of the most common issues I deal with on a day to day basis.

Whilst “bullying” is not defined by statute, ACAS define bullying as “offensive, intimidating, malicious or insulting behaviour, an abuse or misuse of power through means intended to undermine, humiliate, denigrate or injure the recipient”.

Bullying behaviour can take many forms, which can include:-

  • making derogatory comments
  • criticism
  • unwanted banter
  • assault
  • verbal or physical threats
  • humiliation in public

Often employees, who are being bullied at work by either their manager or fellow colleagues, suffer in silence and simply do not know what to do or where to turn. Some employees do not want to bring the issue to their employer’s attention as they find it embarrassing, or they consider they will not be believed, or worried that reporting the same could make the issue even worse. However, not dealing with the issue is not the solution.

If you consider you are being bullied or harassed on the grounds of your race, age, religion or belief, age, disability, sexual orientation, then it is likely that you are the victim of unlawful discrimination. If you are being bullied or harassed for another reason, there are steps you can take to protect yourself, such as by lodging a formal grievance. In certain circumstances, including where your employer does not deal with your grievance properly, you may be able to resign and claim Constructive Unfair Dismissal.
